Welcome to 10s Tracker. These Terms of Service ("Terms") govern your use of the 10s Tracker platform, including our website, mobile applications, and services (collectively, the "Service"). By using 10s Tracker, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using 10s Tracker, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

To use 10s Tracker, you must:

• Be at least 13 years old (or have parental consent)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law

If you are creating an account for a minor, you represent that you are the parent or legal guardian and accept these Terms on their behalf.

3. Account Registration

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. User Types and Responsibilities

Players

As a player, you may track your own matches, view statistics, and register for tournaments. You agree to provide accurate match data and not manipulate scores or statistics.

Parents

As a parent, you may create and manage accounts for your children, track their matches, and register them for tournaments. You are responsible for supervising your children's use of the Service.

Coaches

As a coach, you may track students linked to your account and access their match data. You agree to maintain appropriate professional relationships and protect student data.

Tournament Organizers

As a tournament organizer, you may create and manage tournaments using our platform. You agree to:

• Accurately represent tournament information
• Honor registration and refund policies you establish
• Comply with all applicable laws and regulations
• Maintain appropriate insurance and permits
• Resolve disputes with participants fairly

5. Subscription Plans and Payments

Free and Paid Plans

10s Tracker offers free and paid subscription plans. Features vary by plan as described on our pricing page.

Billing

For paid plans:

• Subscriptions are billed monthly or annually in advance
• Prices are subject to change with 30 days' notice
• You authorize us to charge your payment method automatically
• Failed payments may result in service interruption

Refunds

Subscription fees are generally non-refundable. We may provide refunds at our discretion for exceptional circumstances.

Tournament Fees

Tournament organizers set their own entry fees and refund policies. We collect fees on behalf of organizers and process payouts according to our standard schedule. Platform fees are deducted as described in our organizer pricing.

6. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Harass, abuse, or harm others
• Submit false or misleading information
• Manipulate match scores or tournament results
• Attempt to gain unauthorized access to systems
• Interfere with the proper functioning of the Service
• Use automated means to access the Service without permission
• Create fake accounts or impersonate others
• Use the Service for any illegal or unauthorized purpose

7. Intellectual Property

Our Content

10s Tracker and its content, features, and functionality are owned by 10s Tracker LLC and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

8. Third-Party Services

Our Service integrates with third-party services including:

• Stripe for payment processing
• Supabase for data storage
• OpenAI for AI coaching features
• Infobip for SMS and WhatsApp messaging

Your use of these services is subject to their respective terms and policies.

9. SMS/Text Message Terms

By providing your phone number and opting in to receive text messages from 10s Tracker, you agree to the following:

• Message and data rates may apply. Check with your mobile carrier for details on your text messaging plan.
• Message frequency varies based on your activity and preferences. You may receive messages about lesson reminders, match updates, coach communications, parent invitations, tournament notifications, and account alerts.
• Opt-out: You can opt out at any time by replying STOP to any message. After opting out, you will receive one confirmation message and no further texts unless you opt in again.
• Help: For assistance, reply HELP to any message or contact [email protected].

By opting in, you consent to receive automated text messages at the phone number provided. Consent is not a condition of purchase or use of the Service. You may use 10s Tracker without opting in to SMS notifications.

We will not share your phone number with third parties for marketing purposes. See our Privacy Policy for more information on how we handle your data.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of AI coaching recommendations
• Success of tournaments organized on our platform
• Compatibility with all devices or browsers

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 10s Tracker LLC shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Damages exceeding the amount you paid us in the past 12 months

12. Indemnification

You agree to indemnify and hold harmless 10s Tracker LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination:

• Your right to use the Service ends immediately
• We may delete your data (subject to legal requirements)
• Provisions that should survive termination will remain in effect

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Florida, USA, except where prohibited by law. You waive the right to participate in class actions.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

16. General Provisions

• Governing Law: These Terms are governed by the laws of Florida, USA.
• Entire Agreement: These Terms constitute the entire agreement between you and 10s Tracker.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive future enforcement.
